The use of Codfuel.com by you the supplier, agree that the conditions set forth in this agreement are accepted by you without modification of any of the terms and conditions herein. Your use of this Web site constitutes your agreement as a whole. Accepting these terms are legally equivalent of signing a written document.
Overview
Codfuel.com is not a heating oil company. We do not sell heating oil. Codfuel.com is an avenue for heating oil suppliers to promote and sell their product online to increase orders and reduce advertising expenses. Codfuel.com offers suppliers the availability to accept major credit cards and debit cards over the Internet without the expense of having separate merchant accounts. Orders for heating oil can be taken 24/7/365 without the added expense for additional telephone operators, answering services or staff members to schedule deliveries.
Codfuel.com also offers an avenue for consumers to select a heating oil supplier of their choice and have the convenience to purchase and arrange heating oil to be delivered to a residential or commercial property from that supplier. Heating oil prices that are advertised on this Website are based upon information provided by individual heating oil suppliers without verification by Codfuel.com. Each individual heating oil supplier will have their own user name and password for easy access to their own portal where they can update their own information and oil prices at any time. Codfuel.com makes no representation or warranty regarding the price, quality, delivery or availability of heating oil by the suppliers referred to on this Website.
Heating oil suppliers who sell their product on Codfuel.com are independent entities of Codfuel.com and are selected by the consumer at the time the order is placed. Codfuel.com does not endorse any particular company over another nor does Codfuel.com warranty any service provided by the supplier. All suppliers on Codfuel.com have confirmed to be both licensed by their State or County and claim to be properly insured for consumer protection.
Dealers must hold a retail license for no less than one year before becoming a Codfuel.com supplier. Suppliers who sell heating oil on Codfuel.com agree not to hold Codfuel.com responsible for any form of errors in delivery, errors in pricing, property damage, oil spills, problems with heating system, running out of oil or any faults that were sustained in error or by accident by supplier or consumer. Codfuel.com's sole purpose is to provide a convenient avenue for suppliers to promote their business and for consumers to purchase heating oil and/or oil burner and central air conditioning service.
MINIMUM GALLON and DELIVERY SCHEDULE REQUIREMENTS
Oil dealers must deliver a minimum of 35,000 gallons annually to keep your account active. Dealers that deliver less than 35,000 gallons will be deactivated. You must maintain a minimum of 3 delivery days per week year round to keep your account active.
DELIVERY NECESSITIES
All fuel oil dealers must provide quality customer service to our members and contact them in any even that there is a problem or delay in delivery. Codfuel.com must also be notified as soon as possible if any delays or issues are presented. ANY delivery that was missed or not delivered and has to be transferred to another dealer, the dealer who receives the transferred order will be paid at their current price per gallon. The dealer who did not make the delivery will pay any additional fees whether it is extra per gallon costs to the new dealer, service costs to the customer or the codfuel.com cancellation fee if the order is cancelled as a result of non delivery.
Non-Solicitation Covenant
UNDER NO CIRCUMSTANCES must any supplier promote their own business telephone number, Website or any other type of direct promotion on Codfuel.com without written consent from Codfuel.com. Furthermore, Any supplier directly soliciting Codfuel.com customers online or offline or if involved with any illegal activity will be removed from Codfuel.com permanently. This Includes: knowingly taking orders over the phone from Codfuel.com customers.
In addition, any direct solicitation of Codfuel.com members will be considered breach of this non-compete agreement. Any supplier who registers and sells oil or services on Codfuel.com agrees that their firm, company or employees of their company will not directly or indirectly solicit business from, or attempt to sell or provide the same products or services to any customer, client or member of Codfuel.com while you are still an active supplier on Codfuel.com or for a period of 3 years after your account is terminated. Any supplier that breaches this agreement agrees to pay compensation to Codfuel.com. Compensation will be decided upon the number of members that were serviced by the supplier x $75.00
Use of Trucking Companies
No dealer shall use outside trucking companies without getting approved from Codfuel.com. Any approved trucking company must show proof of insurance, proof of fuel retailers license and truck information before delivering for one of our codfuel.com dealers. Any listed Codfuel.com fuel oil dealer that uses non-approved trucking companies or does not inform Codfuel.com in advance may be removed from Codfuel.com without notice.
EXCLUSIVE SUPPLIER AGREEMENT
Codfuel.com ONLY lists fuel oil dealers that are EXCLUSIVE to Codfuel.com. In return, Codfuel.com vendors can accept Unlimited orders, Cash or Credit card orders, add their custom logo in their ad, offer promo codes, special promotions and have advertising assistance from Codfuel.com. We also promote your Company name on Codfuel.com. We reserve the right to remove a dealers Company name, entire ad, cash ordering ability, logos and special promotions from those suppliers accounts that do not remain exclusive. The exclusive supplier agreement has no additional fees and is accepted by the dealer upon registering their business on Codfuel.com.
PLEASE NOTE: Exclusivity does not include your own Website or Website directories (ie: yp.com, superpages.com, etc.). It refers to Websites that specifically sell oil online where your Company and/or and additional Company names that you are affiliated with and participate as a supplier. Suppliers selling oil on other platforms will be removed from Codfuel.com.
TAXES
It is the responsibility of the supplier to ensure their prices and state or county taxes are current and accurate. Commercial orders are not to be delivered to unless they placed a commercial property order and proper sales tax was charged. Each individual oil supplier agrees to pay all appropriate commercial gross petroleum business tax (PBT) and residential sales tax and state sales taxes where applicable. All payments to fuel oil dealers from Codfuel.com will include the sales tax paid by the customer. Codfuel.com cannot distinguish a residential order from a commercial order due to the automated process. Suppliers are recommended to cancel any commercial order received from Codfuel.com and have them reorder on Codfuel.com and select “commercial delivery” or to collect the appropriate sales tax upon delivery.
Fuel Oil Dealer Membership FEES
There are no monthly fees as a participating fuel oil dealer. There is a small transaction fee per delivery ONLY if Codfuel.com provides you with an oil delivery order. There is no fee for any oil dealer if no oil deliveries are ordered for their company. From 2013 forward, there can only be one account per company. Transaction fees are based upon the total sale. Fees are as follows: (see below for fee schedule)

These fees are based on current rates as of 7/15/2022 Bank rates and Codfuel.com rates are subject to change. You will be notified in advance if there are any changes in rates.
COLLUDING
Under no circumstances will colluding prices between other oil delaers both on the website or off will be tolerated. Colluding is illegal and will be grounds for removal from Codfuel.com
OIL PRICE AGREEMENT
Suppliers agree that their CASH oil prices posted on Codfuel.com will NOT exceed their own prices plus the CASH commission fee. This includes prices quoted over the telephone or displayed on their own website. The current CASH ORDER commission fee of Codfuel.com (.085 cents per gallon) Suppliers agree that their CREDIT CARD oil prices on Codfuel.com will NOT exceed their own prices quoted over the telephone or displayed on their own website plus a maximum of .10 cents per gallon. Codfuel.com reserves the right to change the terms of the agreement to include any or all of the following items:
- Remove suppliers temporarily from the website
- Remove CASH ordering ability from specific suppliers
- Increase cash fee by 5 cents per gallon and credit card percentage by 1%.
- No advanced notice will be sent prior to fee changes.
CASH ORDERS
Codfuel.com does not guarantee that cash customers will be home for delivery. We urge all suppliers to confirm cash orders prior to delivery. We cannot pay for orders that are not home or cancelled at the door. We give our best effort to make sure the customer will be home to accept a cash delivery.
Credit Card Payments
All online payments for heating oil are processed and received by Codfuel.com at the time the order is placed. Depending on form of payment, all transactions on Codfuel.com will appear on consumers bank or credit card statement as Codfuel.com. All payments for heating oil deliveries will be disbursed to the selected supplier after clearing of funds by our merchant bank. All orders will be cleared for payment to suppliers within 3 business days after the order is completed and posted by the oil dealer. Payment will be submitted on the first payment day after posting has been completed for 3 days. (Example: If an order is delivered and posted on Monday before 2pm, payment will be submitted on that Friday)
Payments are made three days per week (Mon, Wed, Fri) excluding Holidays. Payment is made via direct deposit (ACH). Suppliers who sell their product on this website have agreed to pay Codfuel.com 6.95%) of the total amount of each oil delivery for MasterCard, Visa, Discover Card and American Express. This percentage covers online payment transaction fees to accept major credit cards and operational expenses of this website. This is a free service for all consumers.
Order Notification
All oil delivery orders received by Codfuel.com will be forwarded to the selected supplier via electronic mail (e-mail). Order reminders can also be sent optionally to each supplier via text message. Text messaging can be set up within your account by clicking on the "My Account" section. Orders will also be entered directly in each of the suppliers Codfuel.com delivery manager account. Additionally, Codfuel.com and the consumer will also receive a copy of the delivery order via e-mail.
Suppliers MUST check the “delivery manager” section of their Codfuel.com account more than once daily to ensure that they receive all orders from Codfuel.com. Email and text message notifications are NOT 100% reliable and should NOT be used as the only source of obtaining your orders. We offer it as a convenience. Your Delivery Manger section of your Codfuel.com account is 100% reliable. All orders will be in your account regardless of email or text message failure.
Oil Price change at time of delivery
Orders requesting more heating oil that can safely be pumped into the fuel storage tank without the occurrence of a spill are subject to price changes according to the suppliers current price for the allotment of heating oil delivered. Example: if 200 gallons was ordered and the tank filled up at 170 gallons, the price per gallon will be adjusted to the corresponding price for 170 gallons). Oil Dealers agree to have a minimum of a 10 gallon leniency before charging the next highest price bracket. (IE: if a customer orders 200 gallons and the tank fills up at 190, then the 200 gallon price must be charged).
Order Changes at time of delivery (cash orders only)
Deliveries taking more heating oil than on originally ordered are subject to price changes according to the supplier's current price for the allotment of heating oil delivered. (Example: if 200 gallons was ordered and the customer authorizes the supplier at time of delivery to change the order to 250 gallons, payment for the additional oil (example: extra 50 gallons) must be posted to Codfuel.com for that delivery and the delivery receipt must indicate the change and signed by the customer. In either event, the additional oil must be sent to Codfuel.com so it can be added to the customer’s account. Under NO circumstances must any additional oil be charged for without being posted on Codfuel.com by the oil dealer.
Order Changes at time of delivery (credit card orders only)
PLEASE do not deviate from Credit Card Orders. Our system is automated and credit card approval is not accessible for adding more gallons to an existing order. The customer can request less oil than ordered but not more because there is no credit card approval for the additional oil.
Order Posting
Suppliers must “post” their completed deliveries in the “delivery manager” section of their Codfuel.com account within five (5) days of delivery. Posting an order consists of entering the delivery ticket number, amount of gallons delivered and entering the correct oil price for each delivery completed and clicking the “update” link to complete the order. If there are outstanding orders more than five (5) days and they are NOT posted, your Company’s display ad on Codfuel.com will go offline until the orders are posted. If your ad goes offline, it will be re-posted instantly upon posting any outstanding orders.
PLEASE NOTE: If your ad is offline due to non posting over 5 days or you removed your account from codfuel.com , it will delay any payments due until posting is completed.
Additional Fees when posting
Short Deliveries
If you deliver less oil than minimum delivery you advertise, you can add a $25 fee to the same day delivery field when posting. For example: If your minimum delivery is 50 gallons and you deliver less than 40 gallons due to a full tank or other tank related issue, you can add an additional charge of $25 plus the oil being delivered at the price per gallon bracket for their minimum delivery.
PLEASE NOTE: They must take at least 10 gallons LESS than your minimum delivery.
Over Pumps
If you have an over pump in which you delivered more oil than the custmer ordered in error, DO NOT requst the credit card from the customer. Report any over pump to Codfuel.com and we will attempt to retrieve the payment. We also recommend that you contact the customer to alert them of the over pump and ask permission for Codfuel.com to charge their card for the difference. If it's a CASH order and they are willing to pay you for it, make sure you post the over pump to the order when upating it in your account. All gallons must be updated.
Order Transfers
If a dealer cannot deliver to a customer on schedule and the order needs to be transferred to another dealer by Codfuel.com, the new dealer must be paid their posted price by the dealer who it was transferred from. Codfuel.com will make it’s best efforts to find the dealer with a price closes to the ordered price. Payment for the difference will be deducted from the dealers payment and sent to the dealer who accepted the transferred order.
Company Spotlight
Company Spotlight service is a self serve avenue where Oil Dealers can promote their business on Codfuel.com and get top of the page coverage for their advertisement in any area that they select. Payments are also self-serve within your Codfuel.com account. Payment can be made via all major credit cards. Once a Spotlight Area is selected and paid, there are no cancellations or refunds as this is an automated service and it cannot be undone. if you paid for Spotlights, this does not shield you from the terms and conditions of this website. If you are removed for any reason, no refund will be made. Regular spotlight areas will come up in a random order and rotate each dealer if there are more oil dealers in any particular zip code.
Super Spotlight
Super Spotlight is a paid service in which only a single oil dealer per zip code can be displayed. All Super Spotlight ads will be on the top of the page and supersede regular spotlight areas. There is only one oil dealer per zip code, so a Super Spotlight ad is always in view and has no need to rotate between oil dealers.
Super Spotlight ads are by email request only and are on a first come, first serve basis. Please email us to set up Super Spotlights.
Chargeback's
A chargeback is a forced refund to the customer via the merchant's bank account. Chargeback's can occur with any type of business, but it is more prevalent for Internet businesses because of the increased chance of fraud. Each fraudulent credit card transaction usually results in a chargeback. Chargeback's issued for any reason or stopped payment by consumers are the sole responsibility of the supplier. As with any form of payment with the exception of actual cash on delivery, there is a risk involved. All credit card orders completed on Codfuel.com are charged in advance prior to disbursing the order to the oil dealer. Before a purchase can be made on Codfuel.com, all consumers must first agree to the terms of this website which includes their responsibility for payment of any completed oil delivery. Codfuel.com cannot accept responsibility for chargeback's, however in the event of a chargeback, Codfuel.com aid you as best as possible in the unlikely event of a chargeback dispute. If a chargeback is completed in favor of Codfuel.com, all monies that were deducted from your payment will be sent back to you on the next payment after the chargeback has been awarded.
We would recommend that you contact any customer that disputes your payment. Codfuel.com will notify you of any correspondence from customers dispute.
In order to reduce fraudulent transactions, we use the address verification systems code (AVS) when a credit card transaction is submitted for processing. The customer's address is checked against the card-issuing bank's address on file. The transaction results page will return an AVS code, which will tell you whether the address and zip code matched or not.
Chargeback Prevention
The best possible chargeback prevention is to have your delivery ticket signed by the customer as often as possible. A signed receipt is proof that the customer received the delivery and lessens the chances of a chargeback.
Taxes
All local fuel oil taxes are calculated on each order at the corresponding tax rate provided by the supplier during account set up. As tax rates change, it is the responsibility of the supplier to login to the “service areas” section of their account on Codfuel.com and update the tax rate. All applicable sales taxes are forwarded to the supplier from Codfuel.com within the payment of oil deliveries. Payment of all sales tax is the responsibility of the supplier and under no circumstances will Codfuel.com be responsible.
Service Providers
If you are a dealer providing oil burner services, our current rate is $40.00 per order. The customer will pay this fee in advance at the time of placing their order. When you complete any service, please deduct $40.00 from the total service bill and collect the balance from the customer.
There is no posting or updating necessary for burner service. The fee is a flat fee for all orders.
Cancellation of service
Any supplier that wishes to be removed from Codfuel.com can do so at anytime. There is no contract or agreement to sell your product on this website. All suppliers on Codfuel.com have entered their company information on a voluntary basis to increase sales for their business. All monies due to any supplier upon cancellation of service will be paid according to payment terms above. To stop displaying your company, simply login to your account and click "no" on the "display my company" radio button. If any money is due from cash orders to Codfuel.com by the leaving oil dealer; payment is expected upon departure.
Retuning back to Codfuel.com
In the event an oil dealer wants to return to Codfuel.com after departing, there is a waiting period of not less than 6 months and ss many as 18 months, to be determined by the administration of Codfuel.com.
Termination of Account by Codfuel.com
Codfuel.com reserves the right to remove any Company and terminate their account at their discretion.
Intellectual Property
This Web Site and all material is the property of Codfuel.com, including but not limited to copyrights, trademarks, service marks, customer reviews, testimonials, logos, logo's created by Codfuel.com for dealer members or consumer comments are owned by Codfuel.com, and is considered intellectual property which is bound by intellectual property Laws. Any advertisements created by Codfuel.com for its dealers remains the sole property of Codfuel.com and may not be used outside of Codfuel.com without written permission.
